Do I need a lawyer in the
Family Court?

Most people are represented by lawyers in the Family Court. However people can represent themselves. The wisdom of such a decision must be given careful consideration in light of the draw-backs associated with self-representation.

Why instruct a lawyer to represent you in the Family Court?

  • Appearing in the Family Court can be a very stressful experience for people who are already under strain due to family break-down or a family dispute. Representing yourself in the Family Court will add a further dimension of complexity and stress to your life
  • Family Court proceeding can be emotionally charged and the parties themselves are often very emotionally attached to their positions. As well as advising you on the law, your lawyer will provide you with the objective perspective that is needed to evaluate matters, and help you make quality decisions
  • Your lawyer knows the law and has helped people to resolve similar problems before. This experience enables them to present options to you and ways forward that you may not consider by yourself
  • When one party has a lawyer and the other party does not, this may cause an imbalance of power, particularly bargaining power. Therefore self-representation will place you at a disadvantage in this respect.
