Who can apply for a
guardianship order?

Any person can apply to the Family Court for leave (permission) to apply to be appointed the guardian of a child.

Father who was not mother’s spouse, civil union partner, or de facto partner may apply to be appointed as a child's guardian.

Special provision also exists for an eligible spouse or partner to apply to be appointed as an additional guardian of a child.
