Can a child apply for a protection order?
Children can apply for a protection order, but they may need the help of an adult who acts as their representative:
- Children under 16 can apply for a protection order with an adult acting on their behalf
- Children who are 16 can choose to apply through a representative or make their own application (unless they are or have been married, in a civil union or a de facto relationship – in which case they make their own application)
- Applicants who are 17 or older make their own application.
If a child makes an application through a representative, that child is still able to express their views in court. The judge must take account of these views, having regard to the child's age and maturity.
